1. Introduction and scope

This Privacy Policy ("Privacy Policy") explains how Voxifyer AB ("Voxifyer", "we", "us", or "our") collects, uses, stores, shares and otherwise processes Personal Data (as defined below) in connection with the Voxifyer website https://www.voxifyer.com (the "Website"), including the Voxifyer platform and any related services, features, tools, content, materials and communications (collectively, the "Service"). The Privacy Policy also explains your rights in relation to your Personal Data.

This Privacy Policy applies where Voxifyer acts as a data controller, meaning we determine the purposes and means of processing Personal Data, in accordance with applicable data protection laws, including the EU General Data Protection Regulation ("GDPR").

The Privacy Policy forms an integral part of Voxifyer's Terms of Service. Any capitalized terms not defined in this Privacy Policy shall have the meaning given to them in the Terms of Service.

We respect your privacy and are committed to protecting your Personal Data. We encourage you to read this Privacy Policy carefully to understand how we process your Personal Data. If you have any questions or concerns, please feel free to contact us using the contact details provided in Section 15.

2. Definitions

For the purposes of this Privacy Policy, the following definitions apply.

"Personal Data" means any information relating to an identified or identifiable natural person, including, without limitation, an individual's name, address, telephone number, e-mail address, IP-address, image or voice.

"Non-Personal Data" means information that does not, on its own, identify an individual and is therefore not subject to this Privacy Policy. This may include, for example, aggregated or anonymized data, statistical information and technical data relating to the operation and use of the Website and the Service.

Where Non-Personal Data is combined with Personal Data, or otherwise linked to an identifiable individual, it will be treated as Personal Data for the purposes of this Privacy Policy.

3. Categories of Users

Voxifyer processes Personal Data relating to different categories of Users, depending on how individuals interact with the Website and Service. For the purposes of this Privacy Policy, the following categories apply:

3.1 Visitors

Visitors are individuals who browse the Website or otherwise interact with the Service without creating an account. This includes individuals who submit Personal Data through contact forms, newsletter sign-up forms, campaign pages, surveys or similar features made available on the Website.

3.2 Clients

Clients are individuals or companies that create an account to submit inquiries, place orders, obtain rights to use Digital Voices in connection with voice-related projects or purchase other services offered through the Service. Where a Client is a company, this Privacy Policy applies to the processing of Personal Data relating to individuals acting on behalf of the Client, including employees, representatives and other contact persons.

3.3 Talents

Talents are individuals who register an account to create and manage a personal profile and make their artificially generated voices ("Digital Voice/s") available for licensed or otherwise approved use through the Service.

An individual may belong to more than one category over time. For example, a Visitor may later become a Client or a Talent. In such cases, Personal Data will be processed in accordance with the relevant category and for the purposes described in this Privacy Policy.

For the purposes of this Privacy Policy, Visitors, Clients and Talents are collectively referred to as "User/s".

4. Personal Data collected by category

Depending on how you interact with the Website and the Service, we may collect and process the following categories of Personal Data:

User Account Data

  • Information provided by you, or generated, derived or otherwise added by Voxifyer, when registering, updating or managing an account used to access the Service. This may include first and last name, date of birth, address, country of residence, email address, phone number and other contact details, company name and related company information (if applicable), account password and any preferences or options selected by you (such as territory, languages and permitted use categories for Talents).
  • Information required to verify your identity and comply with applicable legal obligations, including identity verification, customer due diligence and anti-money laundering checks.
  • Information relating to projects associated with your account or the use of Digital Voices, including details about their status.

Talent Profile Data

  • Information provided by you, or generated, derived or otherwise added by Voxifyer, when creating, updating or managing your Talent profile. This may include first and last name or stage name (where applicable), profile photo, biography and other profile details. It may also include artificially generated voice samples, related voice data and metadata and information used to identify, categorize, search and filter Digital Voices within the Service, including information about gender, age, languages, accents, speaking styles, tones, pronunciations and other voice characteristics that enable Clients and other Users to find and select suitable Digital Voices.

Digital Voice Data

  • Information provided by you, or generated, derived or otherwise added by Voxifyer, in connection with the creation, development, training, improvement, maintenance, operation and use of your Digital Voices. This may include recordings of your natural voice, artificially generated voice samples and recordings and the Digital Voice itself, including any versions, models, outputs or derivatives thereof. It may also include scripts, text inputs, prompts, instructions, metadata and other parameters relating to languages, accents, speaking styles, tones, pronunciations and other voice characteristics, as well as other information necessary to create, develop, train, improve, maintain, operate and use your Digital Voices.

Project Output Data

  • Information generated through the use of your Digital Voices. This may include artificially generated voice recordings, voice samples and other audio files produced in a Client project based on the input and selected parameters.

Payment and Payout Data

  • Information relating to payments, payouts and related accounting matters. Depending on the category of User, this may include transaction and payment records and history, information about the type of account or pricing plan, payment status and other accounting information necessary to process payments and payouts, manage the commercial relationship and comply with applicable legal and regulatory obligations. Actual payments and payouts are processed through third party payment service providers. Voxifyer does not store full payment card numbers, bank account details or sensitive authentication data. Such information is processed directly by the relevant payment service provider in accordance with its own privacy policy. Voxifyer shares only the Personal Data necessary to process the relevant transactions and ensure that appropriate safeguards are in place.

Visitor Contact Data

  • Information relating to a Visitor, including first and last name, address, country of residence, email address, phone number and other contact details, including company name and related company information (if applicable).

User Communication Data

  • Information you provide when you communicate with us, including any correspondence through email, website forms or other communication channels. This may include, for example, questions, feedback, customer support interactions and any other communications you may have with us.

Technical Device and User Traffic Data

  • Information generated or collected in connection with your use of our Website or Service. This may include IP addresses, general location data, device type, operating system, browser type, dates, times and duration of visits, information about whether you are a first-time or returning visitor, referring URLs and other technical and web traffic information relating to your access to and use of the Website or Service. Information referred to above may be collected through cookies and similar technologies. For more information about our use of these technologies, please see Section 7 below.

Website and Service Usage Data

  • Information relating to your use of and interaction with our Website and Service. This may include page views, navigation patterns, information about how you access and use features, functionalities and content of the Service and other information relating to your activities on the Website or the Service. This category may also include insights about your interests and preferences derived from your use of the Website or Service. Information referred to above may be collected through cookies and similar technologies. For more information about our use of these technologies, please see Section 7 below.

Marketing Data

  • Information relating to your interactions with our marketing and communications activities. This may include information about your engagement with advertisements, marketing campaigns, newsletters and other communications from us, as well as, where applicable, information that you permit third party services to share with us for our marketing purposes. Information referred to above may be collected through cookies and similar technologies. For more information about our use of these technologies, please see Section 7 below.

Auditions Data

  • Information you provide in connection with your participation in our auditions, including contact details, voice samples and recordings and other information provided to us in said context.

Promotions, Contests and Surveys Data

  • Information you provide in connection with your participation in our promotions, contests or surveys, including contact details, feedback and other information provided to us in said context.

5. How we collect Personal Data

We collect Personal Data through various methods, depending on how you interact with the Website and the Service.

5.1 Personal Data you provide directly

You may provide Personal Data to us directly when you:

  • Browse the Website and submit information through contact forms or other interactive features;
  • Sign up for newsletters, campaigns, surveys or other promotional communications;
  • Register an account as a Client or Talent;
  • Create, update or manage your account or profile;
  • Participate in auditions;
  • Submit project requests, briefs or other content through the Service;
  • Communicate with us via email, website forms or other communication channels; or
  • Enter into agreements with us or otherwise provide information necessary for contractual or payment purposes.

5.2 Personal Data collected automatically

When you access or use the Website or the Service, we may automatically collect certain Personal Data and technical information, including:

  • Your IP address and general location data;
  • Device information, such as device type, operating system and browser type;
  • Log data, including timestamps and referring URLs;
  • Usage data relating to how you navigate and interact with the Website and the Service; and
  • Information collected through cookies and similar tracking technologies.

5.3 Personal Data from third parties

In certain circumstances, we may receive Personal Data about you from third parties, including:

  • Payment service providers;
  • Analytics and performance measurement providers;
  • Cloud hosting and infrastructure providers;
  • Social media platforms or other third party services, where you choose to interact with the Website or the Service through such platforms; and
  • Verification and background check providers, including providers performing "Know Your Customer" ("KYC") and "Anti-Money Laundering" ("AML") checks.

We only collect Personal Data from third parties where this is permitted under applicable law and in accordance with this Privacy Policy.

6. Purposes of processing and legal basis

We process Personal Data only where it is necessary for specific, explicit and legitimate purposes, and where a valid legal basis exists under applicable data protection laws, including the GDPR.

The table below describes the purposes for which we process your Personal Data when acting as a data controller, and the corresponding legal basis for such processing.

Talent Profile Data; Digital Voice Data; Output Data; Auditions Data The processing is necessary for entering into, or performance of a contract to which you are a party.
Payment and Payout Purposes — To process Client payments, and to administer payouts of revenue shares or other remuneration to Talents. Payment and Payout Data The processing is necessary for entering into, or performance of a contract to which you are a party.
Regulatory Reporting Purposes — To comply with applicable legal and regulatory obligations, including requirements relating to payments, accounting, tax reporting, financial record-keeping and anti-money laundering laws. Functionality Purposes — To operate and maintain the Website and the Service, including ensuring functionality, availability and performance, as well as identifying, preventing and resolving technical issues, errors and incidents. Technical Device and User Traffic Data; Website and Service Usage Data We have a legitimate interest in using your Personal Data for the purpose of operating and maintaining our Website and Service.
Service Personalization Purposes — To personalize the User experience and provide the Service in a relevant and tailored manner, including making recommendations regarding voices, content and features based on analysis of your interactions with the Service. User Account Data; Talent Profile Data; Technical Device and User Traffic Data; Website and Service Usage Data We have a legitimate interest in using your Personal Data for the purpose of personalizing your experience.
Improvement and Development Purposes — To improve and develop the Service, including its features and functionality, and to enhance the overall user experience. This may include developing new products, features and functionalities, as well as developing, training and improving artificial intelligence voice models and other artificial intelligence systems. Talent Profile Data; Digital Voice Data; Technical Device and User Traffic Data; Website and Service Usage Data We have a legitimate interest in using your Personal Data for the purpose of improving and developing the Service.
Security Purposes — To ensure the security of the Website and the Service, including detecting, preventing and investigating unauthorized access, misuse or activities that violate the Terms of Service, as well as preventing fraud and protecting the integrity of the Service. User Account Data; Talent Profile Data; Payment and Payout Data; Technical Device and User Traffic Data; Website and Service Usage Data We have a legitimate interest in using your Personal Data for the purpose of ensuring safety and security in relation to the Service.
Marketing and Promotional Purposes — To market and promote the Service, including by sending newsletters, marketing communications, offers and recommendations to existing, former and prospective Users through email and other communication channels. Such communications may be personalized based on Users' profiles, preferences, interactions with the Service and, where applicable, information received from third party services, including through profiling. Customer Support and Communication Purposes — To communicate with you regarding the Service, this Privacy Policy and our contractual relationship, including to provide updates and notices, respond to inquiries and requests, and otherwise provide customer and technical support. This may include enforcing our terms and policies, addressing legal matters relating to the Service, protecting our rights and the rights of others and responding to requests from courts, law enforcement agencies, regulatory authorities and other public bodies. Promotions, Contests and Surveys Purposes — To arrange and manage promotions, contests and surveys. Promotions, Contests and Surveys Data We have a legitimate interest in using your Personal Data for the purpose of arranging and managing promotions, contests and surveys.

7. Cookies and tracking technologies

We use cookies and similar tracking technologies to operate and improve the Website and the Service, to understand how users interact with the Website and the Service, and to deliver relevant functionality and communications.

Cookies are small text files that are placed on your device when you visit a website. They may be session cookies, which are deleted when you close your browser, or persistent cookies, which remain on your device until they expire or are deleted.

8. Data retention

We retain Personal Data only for as long as necessary to fulfill the purposes for which it was collected, as described in this Privacy Policy, unless a longer retention period is required or permitted by applicable law.

Retention periods may vary depending on the type of Personal Data, the purpose of processing, and the applicable user category. In general, Personal Data relating to Clients and Talents is retained for the duration of the contractual or customer relationship and for up to two (2) years thereafter. This retention period allows Users to reconnect with the Service and seamlessly resume use of their account. Following this period, Personal Data may be retained for a longer duration where necessary to comply with accounting, tax or regulatory obligations, as well as to administer payments and keep licensing records.

We may also retain certain Personal Data after account closure or termination where required for other legitimate business purposes, including compliance with legal obligations, prevention of fraud or abuse, and the establishment, exercise or defense of legal claims.

Where Personal Data is no longer required, it will be deleted or anonymized in accordance with our data retention practices.

9. Sharing and disclosure of Personal Data

We do not sell or rent Personal Data to third parties. However, we may share or disclose Personal Data in the circumstances described below, where necessary and in accordance with applicable data protection laws.

9.1 Service providers and processors

We may share Personal Data with third party service providers that support the operation of the Website and the Service. These service providers may include providers of hosting and infrastructure, analytics, customer support, communications (including email delivery and other communication services), customer relationship management ("CRM"), marketing and promotional services, payment processing, identity verification, customer due diligence, AML screening and security services.

Where such service providers process Personal Data on our behalf, we ensure that appropriate contractual and technical safeguards are in place, including data processing agreements where required by law, and that they are permitted to process Personal Data only in accordance with our instructions and applicable data protection laws.

9.2 Legal and regulatory disclosures

We may disclose Personal Data where such disclosure is necessary to comply with a legal obligation, court order or lawful request from a public authority, regulator or law enforcement agency.

We may also disclose Personal Data where necessary to establish, exercise or defend legal claims or to protect the rights, property or safety of Voxifyer, our Users or others.

In the event that Voxifyer is involved in a merger, acquisition, restructuring, sale of assets or a similar transaction, Personal Data may be disclosed or transferred to relevant third parties as part of that process, including during the preparatory stages of such a transaction. In such cases, we will take reasonable steps to ensure that any recipient processes Personal Data in a manner consistent with this Privacy Policy and applicable data protection laws.

9.4 External advisors and consultants

Personal Data may also be shared with professional advisors, such as legal, accounting or auditing advisors, where necessary for business operations or compliance with legal obligations.

9.5 Media and communication platforms

We may share your Personal Data with e.g. social media and communication platforms to reach out to you with information and personalized offers for marketing purposes and similar activities relating to our business.

9.6 Other Users

If you are a Talent, we may disclose and share your Personal Data publicly and with other Users and Clients in accordance with the Digital Voice License Terms agreed between us. This may include sharing your Personal Data with Clients who obtain rights to use your Digital Voices through the Service. We may also make samples of your Digital Voices available for Clients and other Users so that they can preview and evaluate the voice before obtaining such rights.

10. International data transfers

Voxifyer is based in the European Union. However, in order to operate the Website and the Service, Personal Data may be transferred to, stored in or otherwise processed in countries outside your country of residence, including countries outside the European Economic Area ("EEA").

Where Personal Data is transferred outside the EEA, we ensure that such transfers are carried out in accordance with applicable data protection laws and are subject to appropriate safeguards. These safeguards may include, where applicable:

  • Transfers to countries that have been recognized by the European Commission as providing an adequate level of data protection;
  • The use of standard contractual clauses approved by the European Commission; or
  • Other lawful transfer mechanisms recognized under applicable data protection laws.

We aim to ensure that Personal Data transferred internationally is protected to a level that is essentially equivalent to that required under EU data protection laws.

11. Data security

We are committed to protecting your Personal Data and maintaining its security. Please note that these rights may be subject to certain limitations and exceptions under applicable law. For example, we may retain and continue to process Personal Data where this is necessary to comply with legal obligations or to establish, exercise or defend legal claims.

We will respond to requests without undue delay and in accordance with applicable legal requirements.

12.2 Right to lodge a complaint

If you believe that our processing of your Personal Data infringes applicable data protection laws, you have the right to lodge a complaint with a competent supervisory authority. You may do so in the EU member state of your habitual residence, place of work or the place of the alleged infringement.

In Sweden, complaints may be submitted to the Swedish Authority for Privacy Protection (Sw. Integritetsskyddsmyndigheten, IMY). Further information is available on their website: https://www.imy.se. Each EU member state has its own supervisory authority responsible for overseeing compliance with data protection laws.

The Website and the Service may contain links to third party websites, services or platforms that are not operated or controlled by Voxifyer.

This Privacy Policy applies only to the processing of Personal Data by Voxifyer in connection with the Website and the Service. We are not responsible for the privacy practices, content or security of any third party websites, services or platforms. Any Personal Data you provide to such third parties is subject to their respective privacy policies and terms.

14. Changes to this Privacy Policy
